Terms and Conditions

These terms are the basis on which Bodo Sperlein Ltd of unit 2.05-2.06 OXO Tower Wharf, London SE1 9PH sells its products to you. By purchasing from Bodo Sperlein Ltd via telephone, email and www.bodosperlein.com/shop you agree to all applicable terms and conditions.


Items sold by us are as described on the site. We make every effort to describe the items clearly and accurately on the site. However, we won’t be liable for any mistaken descriptions or variations from the items delivered.

We don’t give warranties for the items sold by us (warranties may be given by the manufacturers). We are also not responsible for the suitability of the items for any particular purpose. The items are sold on an “as is” basis.

Orders

Order(s) must be made through the order pages on the site. You will be responsible for ensuring the accuracy of your order(s) and we can’t be responsible for any incomplete or inaccurate information in your order(s). Cleared payment must be received by us before your order(s) will be accepted. Once payment clears we will confirm acceptance of your order(s) and provide a receipted invoice for your payment by sending you an email. We reserve the right to reject any order for any reason before payment. All correspondence relating to orders and payment will be by email or phone so you must ensure you provide a correct and active email address and telephone number.

For all orders placed outside of the EU, please be aware that you may be liable to pay import duties and taxes on your order before final delivery; if you are unsure about these charges please consult your local customs office prior to placing your order.

Prices and Payments

Our prices are subject to change and any such change will be notified by amending the relevant prices displayed on the site. Any increase in the prices will only apply to an order placed after the posted increase.

The prices payable on the site are inclusive of taxes but exclusive of delivery charges unless otherwise specified. The packaging and delivery charges will be added to each order before payment. If we make an error in the presentation of the prices on the site we will tell you as soon as possible and you may either cancel or reconfirm your order.  UK VAT, packaging and delivery charges, where applicable, will be added when placing your order, before you confirm the order, and will correspond to the country you have selected for the destination of the purchase. In the event that you change the country of destination, the corresponding prices will be shown. Please note that you may be liable for any local taxes or import duties regarding the order(s) depending on the final shipping destination subject to your country’s tax laws and import duties.

Payment must be made online via the payment methods noted on the site. Payments from outside the UK will be exchanged into pound sterling at the rate, set by our third party payment processor on the payment date.

 

Buy Now Pay Later (Klarna)

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.

  • Pay in [30] days: The payment period is 30 days from shipment of the goods or tickets/ availability date of the service.   • Financing: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly instalments according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna. Further information regarding Slice It including terms and conditions and Standard European Consumer Credit Information you can find here for the markets where this payment method is available: Austria, the United Kingdom, Germany, Sweden, Norway, Denmarkand Finland.

The payment methods Pay in [30] days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna. We can only offer you the payment methods available based on the result of the credit check. General information about Klarna and the user terms per country can be found on klarna.com. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement.

Delivery

Buyers will be notified by e-mail when their orders are dispatched. The product will be delivered to the address you give when placing the order.

Most orders will be dispatched within 5 days from our acceptance of your order, subject to payment and stock availability. Our Couriers will deliver your order within 5 working days (UK), up to 7 working days (EU, USA and Canada) and up to 10 working days (rest of the world). However, timescales or dates indicated for delivery are for guidance only and time for delivery will not be of the essence. We cannot accept orders to be shipped to a PO box, APO or FPO address.

We are reliant on our stock and supply chain and manufacturers in fulfilling orders. If an order is placed by you which is out of stock we will not be able to immediately fulfil it. Some of the products on this site are handmade and can therefore take up to 6-8 weeks to arrive from our manufacturers. If you place an order for an out of stock product we will let you know and delivery may be delayed in the meantime. You will then have the option to proceed or cancel your order and get a full refund within 48 hours of receipt of our email.

As some of our items are hand produced, orders for any out of stock items are subject to a 7 working day period from the date the order was placed until we can place order to restock with our manufacturers. Please be aware this may prolong the delivery of the order.

Ownership of the items you order will pass to you when they are delivered, after which the items will be held at your own risk and we will not be liable for their loss or destruction. Contact us if your order is not received within a reasonable time and we will try and ensure you receive your order as quickly as possible.

The delivery prices are subject to change due to third party courier fuel surcharge increases and any such change will be notified by amending the relevant prices displayed on the site. Any increase in the prices will only apply to an order placed after the posted increase.

Returns, Refunds and Cancellation Policy

We accept returns of items sold to you if the items arrive damaged or broken, as long as you contact us within 48 hours of receipt of the goods, quoting “Returns Request” in the subject heading, and giving us your name, contact details, order number, reasons for return and whether you request replacement or refund. You must then return the goods to us within 5 working days.

On receipt of your return request and the returned goods we will either replace the items or fully refund the price and delivery costs (as per your request) within approximately 30 days receipt of the return depending on stock levels. Where returned items are not in reasonable re-saleable condition or, if return is due to damage or breakage caused by you, we will not be able to provide any replacement or refund.

We can cancel any contract for sale of items if we have insufficient stock to deliver the ordered items or one or more of the items you ordered were listed at an incorrect price due to an error on the site. If we do cancel a contract for sale of any items we will email to let you know and we will refund the price and reasonable delivery costs within approximately 30 days of your order. No additional damage or compensation will be paid. If the product you have selected is not available, any payment made will be reimbursed to your credit card.

As a consumer under the Consumer Protection (Distance Selling) Regulations 2000, you may cancel any order placed on the site for any reason within 14 working days from receiving the goods for a full refund. To do so send us an email at info@bodosperlein.com within 14 working days of receiving your goods, quoting “Cancellation” in the subject heading, and including your email your name, contact details, order number, and stating that you wish to cancel your order. Cancellations received after this statutory cancellation period won’t be valid. All cancelled items must be returned in perfect condition for a full refund within 14 days of cancellation. Shipping costs incurred from customer will not be refunded.

Intellectual Property Rights
All intellectual property rights in the site and the content displayed on the site are owned by, or licensed to, us and unless otherwise specified, may not be used, copied or altered without our written consent. For the avoidance of doubt, this extends to the design, look and feel of the site and all photographs on the site. Intellectual property rights in the watches are the property of the manufacturer. You will not own any intellectual property rights in the watches by buying them. The watches are sold for non-commercial use as a consumer only.
Limitation of Liability

Nothing in these terms and conditions will limit your statutory rights as a consumer or our liability for fraudulent misrepresentation or death or personal injury resulting from our negligence. Subject to this, our total liability to you under these terms will not exceed the price actually paid by you to us for the relevant items giving rise to the alleged claim, including where that liability arises out of our negligence.

We will not be liable to you for any indirect or consequential loss or damage resulting from the sale of the items to you, including without limitation: loss of business, loss of goodwill, loss of profits, loss or corruption of data, damages from claims that the items infringe the intellectual property rights of others, and we will not be liable to you for any acts, omissions or failures of organisations used by us in delivering the items to you.

Termination
We may terminate a contract for sale of goods to you under these terms at any time for any reason by email notice in to you in the event of any breach by you of these terms. On termination, your outstanding order(s) will be immediately cancelled. The price paid to us for the relevant order(s) will be refunded on termination, unless the relevant goods in question have already been despatched to you prior to termination in which case the relevant price will not be refunded.
Restrictions of the Internet
We have no control over the Internet. The site and the order processing system and secure online e-commerce payment system on the site will not be error free or uninterrupted. We will not be liable for any direct or indirect loss or damage which results or may result from your access to or use of the Internet or the site.
Data Protection and Privacy

You agree to the reasonable processing of personal data (as defined in the Data Protection Act 1998) by us for the purposes of processing your orders and delivering goods to you. In processing personal data, we will comply with all relevant legislation and our Privacy Policy displayed on the site.

In order to be able to offer you Klarna’s payment options, we will pass to Klarna certain aspects of your personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you.

Any legal notice to be given under these terms and conditions must be in writing, which may be by email, and will be deemed received 48 hours after posting by first class mail, or on the day of transmission if sent by email.

General

These terms, together with our current prices on the site, contact details and Privacy Policy, set out the whole agreement between us relating to the sale of goods on this site to you by us. We are not liable for failure or delay in meeting our obligations under these terms if caused by circumstances beyond our reasonable control including delays affecting delivery routes or inability or delay in obtaining supplies.

A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these terms.

We reserve the right to amend or update the site and these terms from time to time without notice and it is your responsibility to look through the terms regularly to determine any changes.

Governing Law
These terms and the contract for sale of goods between us will be governed by and interpreted in accordance with English law and the English courts will have jurisdiction to resolve.

Returns and Exchanges

We have made every effort to display as accurately as possible the colours of our products that appear on Bodo Sperlein Shop. However, as computer monitors vary, we cannot guarantee that your monitor's display of any colour will be completely accurate.

All items are quality controlled and checked for any faults before they are dispatched to customers.

Due to the nature of our products, a lot of our pieces are hand finished and therefore products may not be identical to the image you see online. Should you receive an item that is not to you satisfaction, please do get in touch.

We accept returns of items sold to you if the items arrive damaged or broken, as long as you contact us within 24 hours of receipt of the goods, quoting “Returns Request” in the subject heading, and giving us your name, contact details, order number, reasons for return and whether you request replacement or refund. You must then return the goods to us within 5 working days.
